These Terms and Conditions set forth the legally binding terms and conditions for your use of the website and any use and/or purchase of goods and services offered by Paint, Create and Congregate and any of its related companies (hereunder ‘us’, ‘our’ or ‘we’). By accessing this website you agree to comply with these terms and conditions. You warrant that you have the ability to enter into transactions directly with us and by making a request through the website you also warrant to us that you are at least 18 years of age.
All content on this website is property owned by us. This includes graphics, logos, images, text and website design. Therefore, any unauthorised use of them is strictly prohibited and could result in criminal or civil penalties.
All pricing of Goods and Services is in Australian dollars. WE have the discretion to change prices with or without notice to you. All credit cards, debit cards and cash transactions are charged in Australian dollars. All goods and services listed on the website, their information and prices are each subject to change. We reserve the right to modify, suspend or discontinue the provision and/or sale of any goods or services with or without notice to you.
Delays and changes to and cancellation of workshops, events, we will make every effort to deliver our services to you, as promised. On occasion however, the commencement of a session may be delayed due to circumstances beyond our control or unforeseen by us, partly or wholly. It remains our sole discretion to decide whether a session will commence, albeit late, or whether to cancel it altogether. If we elect to cancel a session, whether it be prior to the schedule starting time or after, we will notify you as soon as practicably possible. Where we choose to cancel a session, we will provide you with a credit to the value of your purchase or we will refund your monies to you in the same manner is you made your booking. Please refer to the terms and conditions of our Reschedule Policy.
You acknowledge that we may take photographs and videography of the sessions, which may record images of you at the workshop or event. By booking and attending a session, you expressly and impliedly authorise and permit us to use any recordings we make, which may include images of you, for the promotion and advertising of our business. You agree that all recordings of any nature shall become our property and we may use the recordings for promotional and advertising purposes for our benefit at our sole discretion. You also agree that we may modify the recordings as we see fit for our purpose. If you do not wish for us to record your image, we ask that you notify us no later than at the starting time of the workshop. All persons under the age of 18, Paint Create and Congregate will seek the permission of parent/guardian prior to workshop or event.
Liability and Indemnity, in no event shall we be liable to you or any third party for any loss or profit or any indirect, consequential, exemplary, incidental, special or punitive damages arising from or under, related to or connected with your use of the website or our services. Accessing and using the website and goods and services offered by us are at your own discretion and risk.
Warranties - to the maximum extent permitted by law, we disclaim any warranties, assurances or promises, express or implied, regarding the website and any goods and services or facility it provides.
Where Goods and/or Services are provided to you by a third party at a session (such as the provision of food or drink to you by a bar or restaurant at our workshop or event location held at a third party venue), you acknowledge and agree to hold us harmless and to indemnify us against any injury, damage or loss you may suffer whatsoever arising from or under, related to or connected with the provision of the third party goods and services to you.
Consumption of Alcohol - If we believe that you are under the age of 18 years and you intend to consume or have consumed alcohol during our public workshops or private events, we have the right to ask to leave without compensation. Guests will not be permitted into any of our workshops or participate in any off-site public workshops or private events if you are intoxicated or we believe you are intoxicated.
We reserve the right to change and/or modify all or any part of our terms and conditions, refund policy and privacy policy at any time without notice to you.
Private Events Terms and Conditions
Upon securing your booking, we’ll email you a link to our Gallery of original artwork for you to choose from or we can create a unique painting specifically for you. The cost for us to create this unique painting varies depending on your needs. Contact us to discuss.
We’re open 7 days a week. We offer a 2.5hr painting event can be held between these time slots:
Morning Events: between 10.30am and 1.00pm
Afternoon Events: between 2.30pm and 5.00pm
Evening Events: between 7.00pm and 9.30pm
With the 2.5hr off-site painting events, there is additional flexibility with your time slot. However, the events must fall within a morning, afternoon and evening time-slot, subject to availability.
Your 2.5hr event duration is the entire time you have available to you to hold your event. It includes your arrival time, guest mingling time and your painting time. The agreement entered with us will clearly state your Arrival Time and your Departure Time and the Duration of your event. We allow 30 mins either side of the time slot for setup and pack up as not additional cost to you. Additional time for catering purposes may incur an additional small fee.
The Minimum amount of people to hold a Workshop or Private Event is 10. The Maximum amount of people for a workshop or event, we can accommodate comfortably up to 50-60 people at our partnering venues throughout South Western Sydney. Our largest event so far has been for 65 people. For painting events conducted within private venues and private homes, numbers can be up to 50 depending on the available space. Host to provide tables and chairs and safe social distancing if Covid Restrictions should apply. Venue to provide us with access to running water.
Private Offsite Events – it is your responsibility to provide tables and chairs at any offsite venue and to provide us with access to running water.
Wheelchair Access - All our partnering venues are wheelchair accessible. For private venues to private homes, wheelchair access may be restricted, however we will endeavour to accommodate where possible.
Private Event Deposit requires a $200 non-refundable deposit is required to secure the date and time for your event, and reimbursed once the event has concluded.
Final Payment from Private Event must be made by not less than 14 days prior to your event date.
Rescheduling Private Event Fees - If you require to reschedule your event due to unforeseen circumstances you may do so, and we will hold your non-refundable deposit for up to 3 months giving you time to reschedule. However, a reschedule or cancellations fees may apply directly with the venue or caterer, and this will be your responsibility to oversee and pay incurring costs.
Cancellation Fees, no refund or credit voucher will be provided to you if you cancel or choose to not proceed with rescheduling your event. If you fail to attend your workshop or private event, you will be considered as a ‘No SHOW’ and will not be refunded or receive a credit voucher as you have been catered for and have endured costs for both Paint, Create and Congregate and Host.
Cancellation by the Government due to Covid or Covid Related Reasons, we will make every effort to deliver our services to you, as promised. However, if we are required or effectively required by the Government to close our Workshop or Event venues (whether it be the Federal or relevant State government, municipality or other governing body), and we are therefore unable to run your event, we will issue you a credit voucher for the full value of your order or reschedule you to another date and time of your choice of equivalent value (subject to availability). Alternatively, if we are required or effectively required to reduce the capacity of our venue(s) rather than close, we will issue a credit voucher for the full value of your order or reschedule you to another session of your choice of equivalent value (subject to availability) for the number of guests that were to attend but for exceeding the reduced venue capacity.
Our Reschedule Policy
In this Reschedule Policy, ‘Paint, Create and Congregate’ and any of its related companies may be referred to as ‘us’, ‘our’ or ‘we’.
Credit Vouchers: Credit vouchers may be used to book into any upcoming workshops within the next 6 months from the date it is issued. This does not include No Shows.
No Show: Due to limited seating and enduring costs to both Paint, Create and Congregate and Host your will not be eligible for refund or credit vouchers.
Refunds: Requests for a refund will be considered on a case-by-case basis. If you are eligible for a refund, you will receive the refund in the same way you paid.
If we have to reschedule, we will make every effort to deliver our services to you, as promised.
On occasion, however, we may need to reschedule a session where insufficient bookings are made or Artist Instructor has become unexpectedly indisposed. We will do our utmost to provide sufficient notice to you about any session rescheduling. In the interest of avoiding a session rescheduling, we may elect to reschedule the session at a time which you may consider you received insufficient notice due to your circumstances. We apologise to you in advance for any inconvenience caused.
Where we elect to reschedule a session, we will provide you with a credit to the value of your purchase.
In the event of a cancellation by the government due to Covid or Covid related reasons we will make every effort to deliver our services to you, as promised. However, if we are required or effectively required by the Government to close our workshops (s) (or our partners are required to close their venues) (whether it be the Federal or relevant State government, municipality or other governing body, hereunder “Government”), and we are therefore unable to run the session/event you are booked into, we will issue you a credit voucher for the full value of your order which you can use to reschedule yourself to another session of your choice of equivalent value (subject to availability).
If we are required to or effectively required to reduce the capacity of our workshop(s) (or our partners are required to do same) rather than close, we will issue a credit voucher for the full value of your order which you can use to reschedule yourself to another session of your choice of equivalent value (subject to availability) for those guests that placed their order exceeding the reduced venue capacity.
The terms and conditions of this Reschedule Policy apply whether you paid in cash, by credit card, debit card or with a credit voucher issued by Paint, Create and Congregate.
Cancellation Policy for Privacy Event, please refer to our Terms and Conditions regarding deposits, fees involved when rescheduling or cancelling your event.
Refund Policy for Credit Vouchers, please make a considered decision before requesting a Credit Voucher as we do not offer refunds upon issue. You have 6 months to use.
Refund Methods , if you are entitled to a refund, you will be refunded in the same way you paid. If your method of payment is made using a credit voucher, that payment will be refunded by us by reinstating the refund amount on the credit voucher used to make payment.
Processing of Refunds, depending on the bank you are with, you should receive any monies refunded to you within 7 business days.
